Preamble

By accessing Cleveland Swings (hereinafter "Cleveland Swings", "Site", "http://www.clevelandswings.org" and any derivative URLs), you shall be legally bound by the following agreement (hereinafter "Agreement"). If you do not wish to be legally bound by the Agreement then do not access and/or use Cleveland Swings. We may change this Agreement at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of Cleveland Swings after changes mean you agree to be legally bound by these terms as they are updated and/or amended.

Accounts and Requirements of Age

In compliance with the Children's Online Privacy Protection Act, all individuals holding and maintaining personal accounts at this Site, protected by username and password, at must be of age 13 or older. By opening or using an account at this Site, you represent that are of age 13 or older and are accessing this site in compliance with all applicable laws.

This Site contains content contributed by the Owners and Administration of Cleveland Swings (hereinafter "Owners", "Administration", "we", "us", "our") and individuals not directly associated with Owners of this Site. Content contributed by the Owners include (but are not limited to) Site announcements, forum posts, and FAQ entries (collectively hereinafter "Site Content"). Content contributed by third parties not directly associated with Cleveland Swings include (but are not limited to) forum posts, profiles, calendar, private messages, and other material transmitted to the Site through automated facilities provided on the site, even if such content requires Owner approval before being publicly available (collectively hereinafter "User Content"). Through the remainder of this agreement, Site Content and User Content be collectively referred to as "Content"

Liability

You agree to hold Cleveland Swings owners harmless for any liability that directly or indirectly results from accessing Content on this site. Much of our Content involves information about public and private events and gatherings. You attend these events at your own risk, and shall hold the Owners harmless, waiving any claims of liability against the Owners for any consequences that result from a decision to attend one of these events.

In English: If you go to a dance advertised on this site and break your ankle (for example), you can't sue us for advertising the event, even if the dance was on an ankle-snapping surface.

Grant of License for User Content

If you chose to contribute User Content, you hereby exclusively grant and irrevocably assign to our licensors and us all rights of any kind or nature to such content.

In English: If you make a post or upload an avatar on Cleveland Swings, you grant us the right to reproduce it elsewhere.

Quality of User Content and Adherence to Law

You shall not contribute any Content that is abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where the Site is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with possible notification of your Internet Service Provider and law enforcement. You agree that the Owners have the right to remove, edit, move or close any topic at any time should we see fit.

You shall comply with all applicable laws regarding your use of the Cleveland Swings and contribution of Content.

In English: You can't use the site to do anything illegal, and we may remove posts as we see fit.

These cookies do not contain any of the information you have entered above; they serve only to improve your viewing pleasure. Upon accessing the site, cookies are used to associate your website transactions with your website account.

In English: Accessing Cleveland Swings leaves a digital record that we retain. If we deem it necessary, we may disclose that record along with anything you upload to Cleveland Swings.

Enforceability and Transferability

If any provision of this Agreement is held to be invalid or unenforceable under the laws of your jurisdiction, such provision shall be struck and the remaining provisions shall be enforced - nothing herein is intended to interfere with your statutory rights except to the extent permitted under applicable law. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You may not assign or transfer this Agreement or your rights hereunder, and any attempt to the contrary is void.

Jurisdiction

This agreement is governed in all respects by the laws of the State of Ohio as such laws are applied to agreements entered into and to be performed entirely within Ohio between Ohio residents. You submit to personal jurisdiction in Ohio and further agree that any cause of action relating to this Agreement, this Site, the Owners, or Content shall be brought and maintained in a court in Summit County, Ohio or, at Owner's option, the federal courts of the Northern District of Ohio, and you waive any claim that either such forum is inconvenient.

This Agreement sets forth the entire understanding and agreement between you and Owners with respect to the subject matter hereof.
